TREKMARA: LEGAL TERMS AND PRIVACY FRAMEWORK

PART 1: TERMS OF USE

1. ACCEPTANCE OF TERMS

By downloading, accessing, or using the Trekmara mobile application (the “App”), you (“the User”) agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this App.

2. RIGHT TO MODIFY WITHOUT PRIOR NOTICE

Trekmara reserves the exclusive right, at its sole discretion, to modify, alter, or update these Terms of Use and the Privacy Policy at any time and without prior notice. Such modifications shall become effective immediately upon posting within the App. It is the User’s responsibility to check this section periodically for changes. Your continued use of the App following the posting of changes will mean that you accept and agree to the revisions.

3. SCOPE OF SERVICES

Trekmara operates as a dual-function platform:

• Travel Marketplace: An intermediary platform where third-party travel agencies (“Agencies”) list travel packages for booking.
• Social Network: A platform for Users to share travel moments via text, images, and video (“User Content”).

4. BOOKING AND FINANCIAL TRANSACTIONS

• Intermediary Role: Trekmara is not a travel agency. We do not provide, own, or control the travel services listed. The contract for travel services is strictly between the User and the Agency.
• Liability: Trekmara shall not be held liable for any inaccuracies in listings, cancellations by agencies, or issues arising during the travel experience (e.g., injuries, delays, or service quality).
• Payments: Payments are processed through secure third-party gateways. Trekmara does not store full credit card details.

5. USER-GENERATED CONTENT (UGC) AND MODERATION

• Ownership & License: You retain ownership of your content, but by posting on Trekmara, you grant the Company a worldwide, royalty-free, perpetual license to host, store, use, display, and distribute said content.
• Content Standards: You agree not to post content that is:
  1. Defamatory, obscene, or offensive.
  2. Infringing on the intellectual property rights of others.
  3. Promoting unauthorized commercial ventures.
• Right to Moderate: Trekmara reserves the right to monitor, flag, and remove any User Content at its sole discretion, without notice, and for any reason, including but not limited to violations of these Terms.

 

PART 2: PRIVACY POLICY

1. DATA COLLECTION

We collect information necessary to provide a high-quality travel and social experience:

• Personal Identifiers: Name, email address, and phone number.
• Transaction Data: Details required to fulfill bookings with Agencies.
• Media Data: Photos and videos uploaded by the User.
• Device Data: IP addresses and geolocation (if enabled).

2. USE OF DATA

Data is used to:

• Facilitate travel bookings.
• Personalize the social feed and travel recommendations.
• Ensure platform security and prevent fraudulent activity.

3. DATA SHARING

Trekmara does not sell user data to third parties. Data is only shared with:

• Travel Agencies: Specifically the information required to complete a booking.
• Service Providers: Cloud hosting and payment processors.
• Law Enforcement: When legally compelled to do so.

4. DATA RETENTION AND DELETION

We retain data for as long as your account is active. Users may request account deletion through the App settings, subject to the retention of data required for legal or financial audit purposes.

 

PART 3: LIMITATION OF LIABILITY AND INDEMNITY

1. DISCLAIMER OF WARRANTIES

The App is provided on an “as-is” and “as-available” basis. Trekmara makes no warranties, expressed or implied, regarding the reliability of the social features or the accuracy of travel listings provided by third parties.

2. LIMITATION OF LIABILITY

In no event shall Trekmara, its directors, or its employees be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the App, even if Trekmara has been notified of the possibility of such damage.

3. INDEMNIFICATION

The User agrees to indemnify and hold harmless Trekmara from any claims, losses, or expenses (including legal fees) arising from the User’s breach of these terms or the content they post on the platform.

PART 4: GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Trekmara is incorporated, without regard to its conflict of law provisions.
